1. Toepassingsgebied
Deze voorwaarden zijn van toepassing op alle offertes, overeenkomsten en werken van StoneCare [IN TE VULLEN: rechtsvorm + BTW-nummer + adres] (hierna "StoneCare"), tenzij schriftelijk anders overeengekomen.
2. Offertes
Alle offertes zijn vrijblijvend en 30 dagen geldig. Ze zijn gebaseerd op de door de klant verstrekte informatie en foto's. Blijkt de werkelijke toestand van de gevel af te wijken (bv. verborgen schade), dan kan de offerte in overleg worden aangepast. Meerwerken worden pas uitgevoerd na akkoord van de klant.
3. Uitvoering en termijnen
Uitvoeringstermijnen zijn indicatief. Gevelwerken zijn weersgevoelig; bij ongeschikt weer (vorst, hevige regen) worden de werken in overleg verplaatst zonder dat dit recht geeft op schadevergoeding. De klant zorgt voor normale toegang tot de werf en, indien beschikbaar, aansluiting op water en elektriciteit.
4. Prijs en betaling
Alle prijzen zijn exclusief BTW, tenzij anders vermeld. Facturen zijn betaalbaar binnen [IN TE VULLEN: bv. 14 dagen] na factuurdatum. Bij grotere werken kan een voorschot van [IN TE VULLEN: bv. 30%] gevraagd worden. Bij laattijdige betaling zijn van rechtswege verwijlinteresten en een forfaitaire schadevergoeding verschuldigd conform de wettelijke bepalingen.
5. Herroepingsrecht
Voor overeenkomsten die op afstand of buiten de onderneming worden gesloten, beschikt de consument over een herroepingstermijn van 14 dagen. Dit recht vervalt wanneer de werken met uitdrukkelijk akkoord van de consument vóór het einde van die termijn volledig zijn uitgevoerd.
6. Oplevering, garantie en klachten
De klant controleert de werken bij oplevering. Zichtbare gebreken worden binnen 8 dagen na oplevering schriftelijk gemeld. StoneCare biedt op zijn werken de wettelijke garantie; eventuele bijkomende commerciële garanties (bv. op voegwerk of impregnering) worden uitdrukkelijk in de offerte vermeld.
7. Aansprakelijkheid
De aansprakelijkheid van StoneCare is, behoudens opzet of zware fout, beperkt tot het bedrag van de betreffende factuur. StoneCare is niet aansprakelijk voor schade die voortvloeit uit verborgen gebreken aan de bestaande constructie die redelijkerwijs niet zichtbaar waren bij de inspectie.
8. Toepasselijk recht
Op alle overeenkomsten is het Belgisch recht van toepassing. Geschillen behoren tot de bevoegdheid van de rechtbanken van het arrondissement [IN TE VULLEN: bv. Limburg, afdeling Hasselt], onverminderd dwingende bepalingen inzake consumentenbescherming.

1. Scope
These terms apply to all quotes, agreements and works of StoneCare [TO COMPLETE: legal form + VAT number + address] (hereinafter "StoneCare"), unless agreed otherwise in writing.
2. Quotes
All quotes are without obligation and valid for 30 days. They are based on the information and photos provided by the client. If the actual condition of the façade differs (e.g. hidden damage), the quote may be adjusted in consultation. Additional works are only carried out after the client's approval.
3. Execution and timing
Execution periods are indicative. Façade works are weather-sensitive; in unsuitable weather (frost, heavy rain) the works are rescheduled in consultation, without this giving rise to compensation. The client provides normal access to the site and, where available, connection to water and electricity.
4. Price and payment
All prices are exclusive of VAT unless stated otherwise. Invoices are payable within [TO COMPLETE: e.g. 14 days] of the invoice date. For larger works an advance of [TO COMPLETE: e.g. 30%] may be requested. In case of late payment, default interest and fixed compensation are due by operation of law in accordance with statutory provisions.
5. Right of withdrawal
For contracts concluded at a distance or off-premises, consumers have a withdrawal period of 14 days. This right lapses when the works have been fully performed before the end of that period with the consumer's express consent.
6. Delivery, warranty and complaints
The client inspects the works upon completion. Visible defects must be reported in writing within 8 days of completion. StoneCare provides the statutory warranty on its works; any additional commercial warranties (e.g. on pointing or impregnation) are explicitly stated in the quote.
7. Liability
Except in the case of intent or gross negligence, StoneCare's liability is limited to the amount of the invoice concerned. StoneCare is not liable for damage resulting from hidden defects in the existing structure that were not reasonably visible during inspection.
8. Applicable law
Belgian law applies to all agreements. Disputes fall under the jurisdiction of the courts of the district of [TO COMPLETE: e.g. Limburg, Hasselt division], without prejudice to mandatory consumer protection provisions.

1. Champ d'application
Les présentes conditions s'appliquent à tous les devis, contrats et travaux de StoneCare [À COMPLÉTER : forme juridique + numéro TVA + adresse] (ci-après « StoneCare »), sauf accord écrit contraire.
2. Devis
Tous les devis sont sans engagement et valables 30 jours. Ils sont établis sur la base des informations et photos fournies par le client. Si l'état réel de la façade diffère (p. ex. dégâts cachés), le devis peut être adapté en concertation. Les travaux supplémentaires ne sont exécutés qu'après accord du client.
3. Exécution et délais
Les délais d'exécution sont indicatifs. Les travaux de façade sont sensibles aux conditions météo ; en cas de météo inadaptée (gel, fortes pluies), les travaux sont reportés en concertation, sans que cela ouvre droit à une indemnité. Le client assure un accès normal au chantier et, si disponible, le raccordement à l'eau et à l'électricité.
4. Prix et paiement
Tous les prix s'entendent hors TVA, sauf mention contraire. Les factures sont payables dans les [À COMPLÉTER : p. ex. 14 jours] suivant la date de facturation. Pour les travaux importants, un acompte de [À COMPLÉTER : p. ex. 30 %] peut être demandé. En cas de retard de paiement, des intérêts de retard et une indemnité forfaitaire sont dus de plein droit conformément aux dispositions légales.
5. Droit de rétractation
Pour les contrats conclus à distance ou hors établissement, le consommateur dispose d'un délai de rétractation de 14 jours. Ce droit s'éteint lorsque les travaux ont été entièrement exécutés avant la fin de ce délai avec l'accord exprès du consommateur.
6. Réception, garantie et réclamations
Le client contrôle les travaux à la réception. Les défauts visibles doivent être signalés par écrit dans les 8 jours suivant la réception. StoneCare offre la garantie légale sur ses travaux ; les éventuelles garanties commerciales supplémentaires (p. ex. sur le rejointoiement ou l'hydrofugation) sont expressément mentionnées dans le devis.
7. Responsabilité
Sauf dol ou faute grave, la responsabilité de StoneCare est limitée au montant de la facture concernée. StoneCare n'est pas responsable des dommages résultant de vices cachés de la construction existante qui n'étaient pas raisonnablement visibles lors de l'inspection.
8. Droit applicable
Le droit belge s'applique à tous les contrats. Les litiges relèvent de la compétence des tribunaux de l'arrondissement de [À COMPLÉTER : p. ex. Limbourg, division Hasselt], sans préjudice des dispositions impératives en matière de protection des consommateurs.
